Understanding NYC Local Laws 92 & 94 for Solar and Green Roofs

NYC Local Laws 92 & 94 require most new construction and major roof replacements to include solar panels, a green roof, or both. These sustainable roofing laws apply to residential, commercial, and mixed-use buildings, helping the city cut carbon emissions while lowering energy costs. Smaller homes under 25,000 sq. ft. are generally exempt, but larger multifamily and commercial buildings must comply. Exemptions are made for areas with mechanical equipment, roof decks, or heavy shading. Enforced by the NYC Department of Buildings, these laws ensure new roofs support a cleaner and greener city.

The law applies to new residential, commercial, or mixed-use construction, as well as major roof replacements (Alteration Type 1 or 2). A new roof must include solar PV panels, a green roof, or a combination. Small repairs, like patching leaks, do not trigger the requirement.

Yes. Exemptions apply to areas needed for HVAC equipment, bulkheads, occupied roof decks, FDNY access pathways, or shaded areas unsuitable for solar. Only the available roof area must meet the requirement.
